DeRay McKesson has filed a lawsuit against Fox News and Pirro, accusing her of slandering him during a segment when she talked about a police officer’s defunct lawsuit against him dating back to his involvement in last year’s Black Lives Matter protests in Louisiana when he was falsely arrested.

According to the lawsuit filed against Pirro, Mckesson said the host “made a series of outrageously false and defamatory statements about Mr. McKesson, including that he directed someone to hit the police officer in the face with a rock.”

The statements were made during an appearance on “Fox & Friends" in September.

“We informed Mr. McKesson‘s counsel that our commentary was fully protected under the First Amendment and the privilege for reports of judicial proceedings. We will defend this case vigorously," a Fox News spokesperson said on Friday.

This is the second time Pirro has been in the news in a month. Late last month, she was busted by state police driving 119 mph in the Town of Nichols, in Tioga County, near her hometown Elmira.

Pirro is currently the host of “Justice With Judge Jeanine” on Fox News. She previously hosted the show “Judge Jeanine Pirro” on the CW, which was canceled six years ago. Pirro was the Westchester District Attorney from 1993 until 2005.
