The accused, Esdras Palma, 26, was alleged to have improperly touched a girl, 11, in January, said the lohud.com report.
Judge David Zukerman dismissed the charges against him because "crucial and necessary witness at pretrial hearings" could not be produced by the prosecution, District Attorney Thomas Zugibe told lohud.com.
Palma's lawyers said he "always maintained he never improperly touched the girl," lohud.com said.
